GENERAL TERMS AND CONDITIONS OF SALE
Art 1 - Introduction
- All our sales are subject to our general conditions, whether they are made through our online store or our catalog.
- Any order placed by a buyer through our distribution channels accepts its regulations without restriction or reservation.
Art 2 - Order Contract
The buyer has the option to place orders through our website. The order on our site will only be accepted if the buyer has identified themselves correctly. Our database allows the buyer to know the essential characteristics of the item they wish to order.
The photos are not contractual and do not bind our company in any way. Offers are valid only within the limits of available stock. When a customer has registered their order, it means they accept all the general conditions without any reservations regarding price, product, etc. All contractual data is recorded on the servers of Sellerie Gilbert and can be accessed by the customer after logging in with their access codes.
Art 3 - Prices
All prices in force are those concluded at the time of placing the order. These prices are inclusive of VAT throughout the site. The transportation cost is in addition to the product price and is clearly indicated during your online order. The buyer will choose the one that suits them best from the list provided.
Art 4 - Payment
When you validate your order, you can choose from several online payment methods, all of which are fully secure and encrypted by Stripe. No data passes through our site.
We also offer the option to pay by bank transfer. As indicated on our site, products will only be shipped after payment is received into our account. Unless otherwise notified by us, all purchased items are payable in full before shipment.
We reserve the right to cancel or suspend an order or delivery in case of late payment and without any notice.
Art 5 - Delivery
Packages are stored in our Belgian warehouse and are shipped daily throughout Europe based on the carrier you selected during the finalization of your purchase. Either in express 72 hours throughout Europe, or in 3 to 5 working days by the Belgian post, which then redistributes through the French Colissimo service. All packages leaving our warehouse are checked and in good condition.
It is the customer's responsibility, upon receiving their package, to make reservations if it is not compliant or has been damaged. For this, they must send a complaint by registered mail to the carrier within 8 days from the date of receipt.
In no case can we be held responsible for any delays or destruction of the equipment during transport.
Art 6 - Return of Goods
All items purchased on our site or in our catalog can be returned to us within 10 days, either for an exchange or a refund. Returns are at the customer's expense, and in the case of a refund, it will only be made after verification by our service.
The item must be returned in new condition with its label and must not have been washed or greased. Upon return and verification of the item, the refund is processed within 10 working days.
If, however, the error was due to our shipping service, we will then bear all the return and re-shipping costs of the ordered product.
Art 7 - Warranty
The items are subject to a legal conformity guarantee for goods of 2 years.
In the case of a warranty, the buyer must always contact our customer service either by email or by phone to arrange the terms of it.
As soon as the product is returned and our customer service has checked its malfunction, it will either be repaired by our service or sent back to the manufacturer.
The return period may vary depending on the manufacturer's timeframe; we cannot be held responsible for delays caused by the latter.
Art 8 - Liability
We have, whether in the ordering process, delivery, or others, only an obligation of means. Our liability cannot be engaged following problems encountered on the internet network, service interruption, or the presence of viruses. Orders will be shipped by the carrier you have chosen or that will be proposed to you, and we cannot be held responsible for their delay.
Any risk related to the product will be transferred to you from the delivery, from the moment the risk is transferred to you, we decline all responsibility in case of loss or destruction of the Product.
Art 9 - Right of Withdrawal
The Buyer has a period of fourteen (14) calendar days to cancel or return their order to us, at their expense, the Product(s) they have ordered, without penalties and without indicating the reason.
This period runs from the day following the delivery of the order. The Product(s) must be returned if possible in the original packaging to the following address: Sellerie Gilbert - Rue de Mons 28, 1400 Nivelles, Belgium. Proof of shipment by post or relay must be validated.
If the aforementioned conditions are met, Sellerie Gilbert will refund the buyer, within ten (10) days from the date of receipt in our warehouse of the package, the amounts paid by them, except for shipping costs for shipment and return costs for products.
Art 10 - Data Protection
The customer's order data and information are recorded on Sellerie Gilbert's server(s). They are always available to the customer who logs into their account with their authentication data.

Art 11 - Applicable Law and Jurisdiction
These conditions are concluded between, on the one hand, Sellerie Gilbert - Rue de Mons 28, 1400 Nivelles, Belgium, VAT number BE 0623.966.752 having the site selleriegilbert.be, and on the other hand, the purchasing customer.
All conditions are subject to Belgian law, and in case of dispute, Belgian law applies, and only the courts of Namur in Belgium have jurisdiction.
